Se r\u00e9f\u00e9rant \u00e0 l'avis de certains sp\u00e9cialistes, il exprime toutefois des doutes quant \u00e0 la constitutionnalit\u00e9 du syst\u00e8me majoritaire s'agissant de l'\u00e9lection d'un Parlement (FF 2004 1000-1001). La Commission des institutions politiques (CIP) du Conseil des \u00c9tats s'inscrit en faux contre cette appr\u00e9ciation. La question \u00e9tant d'importance fondamentale pour l'octroi des garanties f\u00e9d\u00e9rales \u00e0 venir, voire pour la jurisprudence du Tribunal f\u00e9d\u00e9ral, la Commission a d\u00e9cid\u00e9 de r\u00e9affirmer dans un rapport ad hoc la constitutionnalit\u00e9 des \u00e9lections au syst\u00e8me majoritaire. Si les Chambres f\u00e9d\u00e9rales devaient confirmer cette position, les doutes qu'exprime le Conseil f\u00e9d\u00e9ral dans son message seront d\u00e9finitivement balay\u00e9s. En effet, selon l'art. 72, al. 2 de la Constitution f\u00e9d\u00e9rale (Cst.), c'est l'Assembl\u00e9e qui est comp\u00e9tente pour l'octroi de la garantie, et non le Conseil f\u00e9d\u00e9ral. \" </p>","Proceedings":"<p></p><p>Au <b>Conseil des \u00c9tats</b>, plusieurs parlementaires ont soutenu le rapport de la Commission. Le Conseiller f\u00e9d\u00e9ral Christoph Blocher a regrett\u00e9 le d\u00e9sagr\u00e9ment provoqu\u00e9 par une remarque qui n'\u00e9tait, selon lui, absolument pas indispensable.Le Conseil des \u00c9tats a adopt\u00e9 le projet du Conseil f\u00e9d\u00e9ral sans opposition. </p><p>Au <b>Conseil national</b>, une minorit\u00e9  a propos\u00e9 de garantir la Constitution grisonne \u00e0 l'exception de l'art. 27 al. 2 et 3.
