Dans son pr\u00e9cis de droit p\u00e9nal, vol. 1, p. 410, le juge f\u00e9d\u00e9ral Bernard Corboz \u00e9crit \u00e0 ce sujet\u00a0: \"Le recel doit porter sur un objet corporel, mobilier ou immobilier\u00a0; cette d\u00e9finition exclut les cr\u00e9ances (non incorpor\u00e9es dans un titre) et autres droits.\" La formulation archa\u00efque de l'article 160 ne permet donc pas de poursuivre les formes modernes de recel. </p><p>Avec ce syst\u00e8me, on arrive \u00e0 la solution absurde bien connue des p\u00e9nalistes, o\u00f9 l'on sanctionne pour recel celui qui re\u00e7oit du voleur la liasse de billets d\u00e9rob\u00e9e dans la caisse de l'\u00e9picier, mais pas celui qui re\u00e7oit le butin par virement bancaire. Cette lacune, essentiellement due \u00e0 l'\u00e9volution du contexte \u00e9conomique et technologique depuis la r\u00e9daction de l'article 160 CP, doit \u00eatre corrig\u00e9e.</p><p>Il faut encore relever que le probl\u00e8me ne peut pas \u00eatre r\u00e9solu par l'application de l'article 305bis CP relatif au blanchiment.
