Selon le r\u00e8glement de nombreuses caisses de pension, la part de la prestation de sortie \u00e0 transf\u00e9rer est pr\u00e9lev\u00e9e autant que possible, en pratique, sur l'avoir de vieillesse surobligatoire. La cons\u00e9quence en est que la rente de celui des ex-conjoints auquel la prestation de sortie est transf\u00e9r\u00e9e est plus basse, \u00e9tant donn\u00e9 que le taux de conversion et le taux d'int\u00e9r\u00eat minimal applicables \u00e0 l'avoir de vieillesse surobligatoire sont moins \u00e9lev\u00e9s que ceux applicables \u00e0 l'avoir de vieillesse obligatoire, r\u00e9gi par la loi f\u00e9d\u00e9rale sur la pr\u00e9voyance professionnelle vieillesse, survivants et invalidit\u00e9 (LPP). Depuis que l'article 22 a \u00e9t\u00e9 introduit dans la LFLP, les taux de conversion et d'int\u00e9r\u00eat appliqu\u00e9s \u00e0 l'avoir surobligatoire sont fix\u00e9s \u00e0 un niveau plus bas que ceux pratiqu\u00e9s pour l'avoir obligatoire. La rente issue de la part surobligatoire est donc moins \u00e9lev\u00e9e.
