La proximit\u00e9 institutionnelle entre le minist\u00e8re public et les autres intervenants de la \"cha\u00eene p\u00e9nale\" (police, service p\u00e9nitentiaire) rend difficile, \u00e0 tout le moins du point vue de l'apparence, le respect de cette garantie de l'ind\u00e9pendance du minist\u00e8re public (art. 4 CPP) lorsqu'il y a lieu d'ouvrir une enqu\u00eate contre un collaborateur de la police ou du service p\u00e9nitentiaire.</p><p>Dans des affaires vaudoises et fribourgeoises r\u00e9centes, impliquant des policiers comme pr\u00e9venus, il a fallu que le Tribunal f\u00e9d\u00e9ral se prononce, avec une certaine s\u00e9v\u00e9rit\u00e9, pour qu'une r\u00e9cusation d'un procureur ou une ouverture de proc\u00e9dure p\u00e9nale aient lieu. \u00c0 l'inverse, l'ouverture \u00e0 Gen\u00e8ve d'enqu\u00eates p\u00e9nales contre des agents de police a suscit\u00e9 une contestation du corps de police, celui-l\u00e0 m\u00eame qui doit quotidiennement collaborer avec le minist\u00e8re public notamment pour l'ensemble des enqu\u00eates pr\u00e9liminaires. Le risque de pression du corps de police sur le minist\u00e8re public cantonal est \u00e9vident.</p><p>Diverses solutions sont envisageables, par exemple l'attribution imm\u00e9diate de la proc\u00e9dure aupr\u00e8s d'un procureur sp\u00e9cial, \u00e9ventuellement intercantonal, voire du Minist\u00e8re public de la Conf\u00e9d\u00e9ration.
