Le procureur extraordinaire ne r\u00e9pondait pas au procureur g\u00e9n\u00e9ral.</p><p>L'autorit\u00e9 de surveillance a-t-elle agi contre ce blocage\u00a0?</p>","ReasonText":null,"DocumentationText":null,"MotionText":null,"FederalCouncilResponseText":"<p>R\u00e9ponse de l'autorit\u00e9 de surveillance du Minist\u00e8re public de la Conf\u00e9d\u00e9ration</p><p>Lors d'une s\u00e9ance de surveillance, le procureur g\u00e9n\u00e9ral de la Conf\u00e9d\u00e9ration a inform\u00e9 l'autorit\u00e9 de surveillance du Minist\u00e8re public de la Conf\u00e9d\u00e9ration de la d\u00e9cision qui allait \u00eatre prise. Apr\u00e8s que cette d\u00e9cision a \u00e9t\u00e9 prononc\u00e9e, le Minist\u00e8re public de la Conf\u00e9d\u00e9ration l'a communiqu\u00e9e \u00e0 l'autorit\u00e9 de surveillance pour information. </p><p>Selon l'art.\u00a029, al.\u00a02, de la loi sur l'organisation des autorit\u00e9s p\u00e9nales, l'autorit\u00e9 de surveillance peut \u00e9dicter des directives \u00e0 l'\u00e9gard du Minist\u00e8re public de la Conf\u00e9d\u00e9ration, sont cependant exclues toutes instructions dans un cas d'esp\u00e8ce relatives \u00e0 l'ouverture, au d\u00e9roulement ou \u00e0 la cl\u00f4ture de la proc\u00e9dure, \u00e0 la repr\u00e9sentation de l'accusation devant le tribunal ou aux voies de recours. Pour cette raison, l'autorit\u00e9 de surveillance s'abstient d'intervenir dans des cas concrets. L'autorit\u00e9 de surveillance est toutefois d'avis que la d\u00e9cision du procureur g\u00e9n\u00e9ral de la Conf\u00e9d\u00e9ration relative au refus de l'autorisation d'ouvrir une poursuite p\u00e9nale peut \u00eatre attaqu\u00e9e devant le Tribunal administratif f\u00e9d\u00e9ral, par les voies de recours ordinaires (art. 15 al. 5, loi sur la responsabilit\u00e9, RS 170.32). Il appartient aux tribunaux et non \u00e0 l'autorit\u00e9 de surveillance d'intervenir si n\u00e9cessaire dans des cas concrets, par le biais de mesures correctrices.
