Cr\u00e9ation d'une base constitutionnelle","Description":null,"InitialSituation":null,"Proceedings":null,"DraftText":null,"SubmittedText":"<p>Conform\u00e9ment \u00e0 l'art.\u00a0160, al.\u00a01, de la Constitution et \u00e0 l'article 107 de la loi sur le Parlement, je d\u00e9pose l'initiative parlementaire suivante\u00a0:</p><p>On cr\u00e9era une base constitutionnelle permettant d'instituer une assurance obligatoire au plan f\u00e9d\u00e9ral contre le risque sismique\u00a0; cette base constitutionnelle pourrait avoir la teneur suivante\u00a0: </p><p>Art. 98a Assurance tremblement de terre</p><p>Al. 1</p><p>La Conf\u00e9d\u00e9ration l\u00e9gif\u00e8re sur l'assurance tremblement de terre des b\u00e2timents obligatoire pour l'ensemble de la Suisse.</p><p>Al. 2</p><p>Elle tient compte des comp\u00e9tences des cantons et des structures du march\u00e9.</p><p>Al. 3</p><p>Elle peut contribuer au financement de l'assurance tremblement de terre et fournir des prestations financi\u00e8res compl\u00e9mentaires dans des circonstances extraordinaires.</p>","ReasonText":"<p>Selon les r\u00e9gions, la Suisse est expos\u00e9e \u00e0 un risque sismique moyen \u00e0 \u00e9lev\u00e9. \u00c0 la diff\u00e9rence d'autres dommages naturels, ce risque n'est aujourd'hui pas obligatoirement couvert. Le Parlement a constat\u00e9 qu'il s'agissait d'une lacune et l'a confirm\u00e9 en adoptant la motion Fournier 11.3511. Or, le Conseil f\u00e9d\u00e9ral propose \u00e0 pr\u00e9sent de classer cette motion (cf. rapport du 20 juin 2014). Le Conseil f\u00e9d\u00e9ral ne remet pas en question la n\u00e9cessit\u00e9 de cr\u00e9er une assurance obligatoire contre le risque sismique, mais pr\u00e9cise que, \"pour qu'une assurance tremblement de terre obligatoire dans toute la Suisse puisse \u00eatre cr\u00e9\u00e9e au niveau f\u00e9d\u00e9ral, il est indispensable de doter la Conf\u00e9d\u00e9ration d'une nouvelle comp\u00e9tence constitutionnelle\". </p><p>Le texte propos\u00e9 correspond \u00e0 la proposition faite dans le rapport pr\u00e9cit\u00e9 (cf. FF 2014 5358).
