Il n'a pas statu\u00e9 en revanche sur les cas d'aide f\u00e9d\u00e9rale et il n'a pas non plus indiqu\u00e9 quand et sous quelles conditions ce contr\u00f4le relatif \u00e0 un \u00e9ventuel rendement excessif doit \u00eatre possible. La cause a \u00e9t\u00e9 renvoy\u00e9e en l'esp\u00e8ce \u00e0 la cour cantonale pour examiner ces points. Cela \u00e9tant, il n'appartient pour l'instant pas au Conseil f\u00e9d\u00e9ral de se prononcer sur cette cause qui n'est juridiquement pas encore tranch\u00e9e. Le Conseil f\u00e9d\u00e9ral suivra toutefois attentivement l'\u00e9volution de la jurisprudence en la mati\u00e8re.
