Limiter l'article 270 CO aux cas de p\u00e9nurie","Description":null,"InitialSituation":null,"Proceedings":null,"DraftText":null,"SubmittedText":"<p>Conform\u00e9ment \u00e0 l'art.\u00a0160, al.\u00a01, de la Constitution et \u00e0 l'article 107 de la loi sur le Parlement, je d\u00e9pose l'initiative parlementaire suivante\u00a0:</p><p>Le Code des obligations (CO\u00a0; RS 220) est modifi\u00e9 comme suit\u00a0: </p><p>Art. 270 CO</p><p>Sur un march\u00e9 de p\u00e9nurie, lorsque le locataire estime que le montant du loyer initial est abusif au sens des articles 269 et 269a CO, il peut le contester devant l'autorit\u00e9 de conciliation dans les 30 jours qui suivent la r\u00e9ception de la chose et en demander la diminution\u00a0:</p><p>a. s'il a \u00e9t\u00e9 contraint de conclure le bail par n\u00e9cessit\u00e9 personnelle ou familiale\u00a0; ou</p><p>b. si le bailleur a sensiblement augment\u00e9 le loyer initial pour la m\u00eame chose par rapport au pr\u00e9c\u00e9dent loyer.</p>","ReasonText":"<p>La l\u00e9gitimit\u00e9 des r\u00e8gles sur le rendement abusif d\u00e9pend de la situation de p\u00e9nurie sur le march\u00e9. Dans ces cas, il peut \u00eatre admis que les locataires puissent \u00eatre contraints de conclure des contrats de bail au loyer abusif.</p><p>Il appara\u00eet contradictoire de parler de loyer abusif sur des march\u00e9s qui ne connaissent pas de p\u00e9nurie de logements.
