Dans le domaine des entraves commerciales non tarifaires, il a entre autres d\u00e9cid\u00e9 d'examiner si les cons\u00e9quences \u00e9conomiques n\u00e9gatives des exceptions au principe du \"Cassis de Dijon\" au sens de l'art.\u00a016a, al.\u00a02, let.\u00a0e, de la loi f\u00e9d\u00e9rale sur les entraves techniques au commerce (RS 946.51) pouvaient \u00eatre r\u00e9duites et si oui, par quels moyens.
