Suppression de la clause qui prot\u00e8ge les auteurs d'une infraction passible de l'expulsion","Description":null,"InitialSituation":null,"Proceedings":null,"DraftText":null,"SubmittedText":"<p>Me fondant sur les articles 160 alin\u00e9a 1 de la Constitution et 107 de la loi sur le Parlement, je d\u00e9pose l'initiative parlementaire suivante\u00a0:</p><p>L'art.\u00a066a, al.\u00a02, du Code p\u00e9nal (CP\u00a0; RS 311.0) est \u00e0 abroger.</p>","ReasonText":"<p>Conform\u00e9ment \u00e0 l'article 121 de la Constitution, les \u00e9trangers condamn\u00e9s pour avoir commis une grave infraction sont priv\u00e9s de leur titre de s\u00e9jour. La condamnation pour une des infractions \u00e9num\u00e9r\u00e9es \u00e0 l'art.\u00a066a, al.\u00a01, CP entra\u00eene obligatoirement l'expulsion pour une dur\u00e9e de cinq \u00e0 quinze ans.</p><p>Les chiffres montrent que cette expulsion obligatoire n'est effectivement appliqu\u00e9e que dans 54\u00a0% des cas. Presque une expulsion sur deux n'est pas effectu\u00e9e, malgr\u00e9 l'obligation pr\u00e9vue par la loi. Dans les faits, la pratique suivie jusqu'\u00e0 l'automne 2010 en la mati\u00e8re est ainsi prorog\u00e9e sans solution de continuit\u00e9. Cette approche est en contradiction avec les exigences exprim\u00e9es dans l'initiative sur le renvoi, destin\u00e9e \u00e0 durcir la pratique des tribunaux et \u00e0 l'\u00e9lever \u00e0 un niveau minimal uniforme dans toute la Suisse.
