Ne pourrait-on pas d\u00e9sormais combattre la crise du coronavirus avec le droit ordinaire?","Description":null,"InitialSituation":null,"Proceedings":null,"DraftText":null,"SubmittedText":"<text><p>Tirant les cons\u00e9quences de l'\u00e9volution de l'\u00e9pid\u00e9mie, le Conseil f\u00e9d\u00e9ral a d\u00e9cid\u00e9 lors de sa s\u00e9ance du 27 mai 2020 de ne plus consid\u00e9rer \u00e0 compter du 19 juin 2020 la situation comme extraordinaire au sens de l'art. 7 de la loi sur les \u00e9pid\u00e9mies (LEp), mais \u00e0 nouveau comme particuli\u00e8re au sens de l'art. 6 LEp. Cette \u00e9volution, justifi\u00e9e par le net recul du nombre d'infections, est certes un pas dans la bonne direction, mais la d\u00e9cision du Conseil f\u00e9d\u00e9ral a \u00e9galement cr\u00e9\u00e9 de l'ins\u00e9curit\u00e9. Les personnes et entreprises directement concern\u00e9es en particulier se demandent ainsi ce que signifie cette d\u00e9cision pour les prochaines semaines et ce qui emp\u00eache un retour complet \u00e0 la normalit\u00e9. Aussi le Conseil f\u00e9d\u00e9ral est-il pri\u00e9 de r\u00e9pondre aux questions pressantes ci-apr\u00e8s en suivant la proc\u00e9dure d'urgence\u00a0:</p><p>1. Quelles conditions constitutives d'une situation particuli\u00e8re au sens de l'art. 6, al. 1, let. a et b, LEp sont-elles encore remplies actuellement\u00a0?</p><p>2. Compte tenu de l'\u00e9volution de l'\u00e9pid\u00e9mie, le Conseil f\u00e9d\u00e9ral estime-t-il qu'il sera n\u00e9cessaire \u00e0 court terme de faire \u00e0 nouveau usage des comp\u00e9tences que lui conf\u00e8re l'art. 6, al. 2, LEp\u00a0?</p><p>3. Dans quelles conditions le Conseil f\u00e9d\u00e9ral ferait-il usage des comp\u00e9tences que lui conf\u00e8re l'art. 185, al. 3, Cst. (droit d'urgence) apr\u00e8s que la situation ne serait plus consid\u00e9r\u00e9e comme particuli\u00e8re au sens de l'art. 6 LEp et que nous serions revenus \u00e0 la situation normale\u00a0?</p><p>4. Le recours \u00e0 l'art. 185, al.3, Cst. ne serait-il pas paradoxal en situation normale\u00a0?</p><p>5. \u00c0 partir de quand, en cas de retour \u00e0 la situation normale, l'ordonnance 2 COVID-19 du Conseil f\u00e9d\u00e9ral n'aurait-elle plus de base l\u00e9gale et n'aurait-elle donc plus d'effet\u00a0?</p><p>6.
