La situation particuli\u00e8re a \u00e9t\u00e9 d\u00e9clar\u00e9e pour la premi\u00e8re fois le 28 f\u00e9vrier 2020 en Suisse pour des motifs \u00e9pid\u00e9miologiques sur la base de la disposition susmentionn\u00e9e de la loi sur les \u00e9pid\u00e9mies. Elle n\u2019a \u00e9t\u00e9 lev\u00e9e qu\u2019apr\u00e8s plus de deux ans, le 1er avril 2022.<br>2. M\u00eame si la date \u00e0 laquelle l\u2019OMS a d\u00e9clar\u00e9 la pand\u00e9mie et celle de l\u2019\u00e9tat d\u2019urgence constitutionnel que repr\u00e9sente la situation particuli\u00e8re ne recoupent pas, on ne peut exclure un lien entre les deux.<br>3. Selon les projets actuels de modification du R\u00e8glement sanitaire international et de nouveau trait\u00e9 de l\u2019OMS sur les pand\u00e9mies, les motifs justifiant la d\u00e9claration par l\u2019OMS de pand\u00e9mies seront \u00e9tendus \u00e0 l\u2019infini (par ex. nouveaux sous-types de grippe et changement climatique). Les pand\u00e9mies d\u00e9clar\u00e9es par l\u2019OMS seront donc forc\u00e9ment plus nombreuses et plus longues.<br>4. Comme les recommandations de l\u2019OMS seront contraignantes \u00e0 l\u2019avenir pour les \u00c9tats signataires en vertu du droit international (modification des art. 1, 13A, 42, 53A et 54bis du r\u00e8glement pr\u00e9cit\u00e9 en relation avec son art. 18), il faut absolument s\u00e9parer tr\u00e8s clairement la d\u00e9claration par l\u2019OMS d\u2019une situation d\u2019urgence de sant\u00e9 publique de port\u00e9e internationale, d\u2019une part, et l\u2019\u00e9tat d\u2019urgence que repr\u00e9sente la situation particuli\u00e8re en Suisse, d\u2019autre part, tant formellement que mat\u00e9riellement. La Conf\u00e9d\u00e9ration et les cantons prennent notamment les mesures n\u00e9cessaires pour pr\u00e9venir et limiter \u00e0 temps les dangers et les atteintes \u00e0 la sant\u00e9 publique.
