Des voies de notification harmonis\u00e9es pour la Suisse num\u00e9rique","Description":null,"InitialSituation":null,"Proceedings":null,"DraftText":null,"SubmittedText":"<p>Le Conseil f\u00e9d\u00e9ral est charg\u00e9 de veiller, dans le cadre des adaptation l\u00e9gislatives en cours, \u00e0 ce que les obligations et proc\u00e9dures de notification dans le domaine de la cybers\u00e9curit\u00e9 soient faciles \u00e0 appliquer pour les entreprises, en particulier les PME, en les harmonisant et en \u00e9vitant les doublons, afin de renforcer la place \u00e9conomique suisse.</p><p>Concr\u00e8tement, il convient de pr\u00e9voir :</p><ol style=\"list-style-type:decimal;\"><li>Une proc\u00e9dure unique et coordonn\u00e9e de notification des incidents de s\u00e9curit\u00e9 concernant les produits et services num\u00e9riques.</li><li>Aucune duplication et aucun nouveau canal de notification suppl\u00e9mentaire.</li><li>Des formulaires, d\u00e9lais et crit\u00e8res harmonis\u00e9s, align\u00e9s sur la loi sur la s\u00e9curit\u00e9 de l\u2019information et la loi sur la protection des donn\u00e9es.</li><li>Une norme d\u2019efficacit\u00e9 sup\u00e9rieure au niveau de l\u2019UE : les entreprises suisses doivent b\u00e9n\u00e9ficier de processus de notification simples, num\u00e9riques et fiables.</li></ol>","ReasonText":"<p>Le 20 ao\u00fbt 2025, le Conseil f\u00e9d\u00e9ral a charg\u00e9 le DDPS d\u2019\u00e9laborer, avec le DETEC et le DEFR, une base l\u00e9gale relative \u00e0 la cyber-r\u00e9silience des produits num\u00e9riques. Les d\u00e9veloppements internationaux doivent \u00eatre pris en compte, en particulier le Cyber Resilience Act ainsi que les simplifications des processus de notification pr\u00e9vues dans le Digital Omnibus de l'UE. Ces r\u00e9formes poursuivent le m\u00eame objectif : r\u00e9duire les charges administratives et consolider les proc\u00e9dures de notification.</p><p>Aujourd\u2019hui, la conception des obligations et proc\u00e9dures de notification en Suisse est h\u00e9t\u00e9rog\u00e8ne. Les incidents de s\u00e9curit\u00e9 doivent \u00eatre annonc\u00e9s \u00e0 diff\u00e9rentes autorit\u00e9s et points de contact, selon le cas, avec des d\u00e9lais vari\u00e9s : PFPDT, NCSC, FINMA, autres autorit\u00e9s sectorielles ou services d\u2019achat de l\u2019administration. Sans coordination claire, de nouvelles obligations de notification li\u00e9es aux produits num\u00e9riques renforceront encore la fragmentation et augmenteront la charge administrative, en particulier des PME.</p><p>Le Conseil f\u00e9d\u00e9ral est donc invit\u00e9 \u00e0 reprendre de mani\u00e8re coh\u00e9rente les simplifications pr\u00e9vues dans le Digital Omnibus: r\u00e9duction des notifications multiples et \u00ab Single Entry Point \u00bb pour les incidents de s\u00e9curit\u00e9. La Suisse doit suivre cette approche et m\u00eame l\u2019am\u00e9liorer dans l\u2019int\u00e9r\u00eat de sa comp\u00e9titivit\u00e9.
