Cette \u00e9num\u00e9ration peut se limiter \u00e0 des renvois aux consid\u00e9rations essentielles de la d\u00e9cision du SEM contest\u00e9e.</p>","ReasonText":"<p>La pr\u00e9sente initiative parlementaire vise \u00e0 pr\u00e9ciser que les motivations sommaires vis\u00e9es \u00e0 l'art. 111a, al. 2, LAsi doivent effectivement \u00eatre concises et se limiter aux consid\u00e9rations essentielles.</p><p>La loi pr\u00e9voit aujourd'hui d\u00e9j\u00e0 que les recours manifestement fond\u00e9s ou infond\u00e9s peuvent faire l'objet d'une proc\u00e9dure devant un juge unique, avec l'accord d'un deuxi\u00e8me juge (art. 111, let. e, LAsi). L'art. 111a, al. 2, LAsi dispose en outre que ces prononc\u00e9s sur recours ne sont motiv\u00e9s que sommairement.</p><p>Dans la pratique, cette exigence n'est toutefois pas respect\u00e9e de mani\u00e8re suffisamment rigoureuse. Il n'est pas rare en effet que les d\u00e9cisions rendues par un juge unique comptent largement plus de dix pages. Cette pratique va \u00e0 l'encontre de l'objectif de la disposition. Une motivation sommaire doit se limiter \u00e0 l'essentiel et ne pas se transformer, dans les faits, en une motivation mat\u00e9rielle d\u00e9taill\u00e9e.</p><p>L'ajout propos\u00e9 pr\u00e9cise donc qu'une motivation sommaire peut \u00e9galement prendre la forme de mots-cl\u00e9s ou se limiter \u00e0 des renvois aux principales consid\u00e9rations de la d\u00e9cision du SEM contest\u00e9e.
