En revanche, il faut emp\u00eacher que le syst\u00e8me d\u2019asile soit bloqu\u00e9 par celles qui d\u00e9posent des recours sans faits ou \u00e9l\u00e9ments de preuve nouveaux et qui n\u2019ont donc vraisemblablement aucune chance d\u2019obtenir gain de cause. Le TAF croule sous les recours en mati\u00e8re d\u2019asile. Cependant, la proportion de recours admis a nettement diminu\u00e9 depuis 2019. Les recours manifestement vou\u00e9s \u00e0 l\u2019\u00e9chec, d\u00e9pos\u00e9s plusieurs fois de suite ou visant uniquement \u00e0 retarder la proc\u00e9dure mobilisent des ressources et prolongent les dossiers qui m\u00e9ritent un examen approfondi.</p><p>Le droit en vigueur pr\u00e9voit d\u00e9j\u00e0 des proc\u00e9dures simplifi\u00e9es pour les recours manifestement infond\u00e9s. La motion veut aller plus loin&nbsp;: le TAF devrait pouvoir d\u00e9cider, d\u00e8s la r\u00e9ception du recours, dans le cadre d\u2019un examen pr\u00e9liminaire, s\u2019il y a lieu ou non de proc\u00e9der \u00e0 un examen approfondi. Dans les cas manifestement vou\u00e9s \u00e0 l\u2019\u00e9chec, une d\u00e9cision d\u00e9finitive, bri\u00e8vement motiv\u00e9e, doit pouvoir \u00eatre rendue rapidement.</p><p>La protection juridique est garantie, car l\u2019examen pr\u00e9alable resterait effectu\u00e9 par le TAF. Un examen approfondi continuera d\u2019\u00eatre men\u00e9 si des indices s\u00e9rieux laissent supposer une violation du principe de non-refoulement, l\u2019existence de nouveaux faits pertinents ou des vices de proc\u00e9dure importants.
