La r\u00e9vision devra \u00e9galement pr\u00e9ciser les modalit\u00e9s de coop\u00e9ration entre cantons et Conf\u00e9d\u00e9ration dans ces proc\u00e9dures.</p>","ReasonText":"<p>L'art. 24 CPP attribue \u00e0 la Conf\u00e9d\u00e9ration la poursuite des organisations criminelles (art. 260ter CP) lorsqu'elles pr\u00e9sentent une pr\u00e9pond\u00e9rance \u00e0 l'\u00e9tranger ou concernent plusieurs cantons sans centre de gravit\u00e9 clairement d\u00e9terminable. Dans la pratique, cette disposition est souvent interpr\u00e9t\u00e9e comme signifiant que la lutte contre les organisations criminelles rel\u00e8verait principalement des autorit\u00e9s f\u00e9d\u00e9rales. Une telle interpr\u00e9tation est probl\u00e9matique et ne correspond pas \u00e0 l'esprit de la loi.</p><p>&nbsp;</p><p>En effet, les deux principales hypoth\u00e8ses justifiant une comp\u00e9tence f\u00e9d\u00e9rale ne peuvent g\u00e9n\u00e9ralement \u00eatre \u00e9tablies qu'apr\u00e8s le d\u00e9but des investigations. Au moment de l'ouverture d'une enqu\u00eate, les autorit\u00e9s ignorent souvent o\u00f9 se situent pr\u00e9cis\u00e9ment les activit\u00e9s criminelles d'une organisation criminelle, quels cantons sont concern\u00e9s et si les faits pr\u00e9sentent effectivement une pr\u00e9pond\u00e9rance \u00e0 l'\u00e9tranger. La comp\u00e9tence est donc par d\u00e9faut cantonale, du moins dans la phase initiale.</p><p>&nbsp;</p><p>Cette r\u00e9alit\u00e9 est d'autant plus importante que la criminalit\u00e9 organis\u00e9e s'implante toujours davantage en Suisse.
