Un simple ajout dans l\u2019ordonnance du 27&nbsp;juin 2007 sur les professions m\u00e9dicales (OPM\u00e9d) suffira \u00e0 pr\u00e9ciser les exigences minimales en mati\u00e8re de (prolongation de) couverture d\u2019assurance.</p>","ReasonText":"<p>Dans le sillage de la reconnaissance des titres postgrades \u00e9trangers vis\u00e9e \u00e0 l\u2019art.&nbsp;21 LPM\u00e9d (\u00e9quivalence selon l\u2019accord sur la libre circulation des personnes conclu avec l\u2019UE), on a vu se multiplier en Suisse les affaires o\u00f9 un prestataire de services prend le large apr\u00e8s la survenue d\u2019un dommage, alors que sa responsabilit\u00e9 de m\u00e9decin est engag\u00e9e. Certes, depuis la modification de la loi du 2&nbsp;avril 1908 sur le contrat d\u2019assurance (art.&nbsp;60, al.&nbsp;1<sup>bis</sup>&nbsp;LCA), les personnes l\u00e9s\u00e9es peuvent se retourner directement contre la compagnie d\u2019assurance responsabilit\u00e9 civile, \u00e0 condition toutefois qu\u2019une couverture existe. \u00c9tant donn\u00e9 cependant que les assurances responsabilit\u00e9 civile professionnelle ont adopt\u00e9 le principe de la r\u00e9clamation (claims made), on voit aussi se multiplier les affaires dans lesquelles les patients concern\u00e9s, qui ont fait valoir leurs droits \u00e0 des dommages-int\u00e9r\u00eats, repartent bredouilles parce que la couverture d\u2019assurance a expir\u00e9 entre-temps et que le prestataire de services n\u2019a pas pr\u00e9vu, dans les dispositions de son contrat d\u2019assurance, une prolongation de couverture suffisante. L\u2019art.&nbsp;68, al.&nbsp;2, de la loi f\u00e9d\u00e9rale du 19&nbsp;d\u00e9cembre 1958 sur la circulation routi\u00e8re pr\u00e9voit une solution \u00e0 cet \u00e9gard&nbsp;: l\u2019assureur doit annoncer \u00e0 l\u2019autorit\u00e9 la suspension ou la cessation de l\u2019assurance<strong></strong>. La couverture \u00e0 l\u2019\u00e9gard des l\u00e9s\u00e9s est maintenue pendant 60&nbsp;jours au plus apr\u00e8s cette notification, \u00e0 moins que l\u2019assurance n\u2019ait \u00e9t\u00e9 au pr\u00e9alable remplac\u00e9e par une autre. L\u2019obligation d\u2019annoncer de l\u2019assureur peut \u00eatre mise en place par un simple ajout dans la l\u00e9gislation.
