Ce rapport pr\u00e9sentera la situation juridique en vigueur en Suisse ainsi que la jurisprudence y aff\u00e9rente et analysera dans quelle mesure les dispositions existantes et leur application garantissent la protection du secret de fonction, d\u2019une part, et un contr\u00f4le efficace des acteurs \u00e9tatiques par les m\u00e9dias, d\u2019autre part.</p><p>2. Il conviendra ensuite de montrer quelles adaptations l\u00e9gislatives conformes \u00e0 la CEDH l\u2019on pouvrrait envisager afin de garantir un rapport plus \u00e9quilibr\u00e9 entre la libert\u00e9 des m\u00e9dias, la protection des sources journalistiques et une poursuite efficace des violations du secret de fonction. Il faudra notamment \u00e9tudier, \u00e0 cet \u00e9gard, comment la protection des sources peut \u00eatre limit\u00e9e aux personnes dont l\u2019implication est n\u00e9cessaire pour garantir la libert\u00e9 des m\u00e9dias (cf. art. 172 CPP) et comment la protection contre la mise sous s\u00e9questre peut \u00e9galement \u00eatre limit\u00e9e aux professionnels des m\u00e9dias concern\u00e9s, sans \u00eatre \u00e9tendue aux auteurs m\u00eames de la violation du secret (cf. art. 264 CPP).</p><p>3. Enfin, il s\u2019agira d\u2019examiner si la protection des sources journalistiques et celle des lanceurs d\u2019alerte doivent \u00e0 l\u2019avenir \u00eatre davantage garanties par des motifs justificatifs relevant du droit mat\u00e9riel plut\u00f4t que par des privil\u00e8ges \u00e9tendus relevant de la proc\u00e9dure p\u00e9nale.
